Can contractors be entitled to super?

Some contractors can be entitled to super even when they have an ABN and issue invoices. The answer depends on the arrangement and the applicable super rules. An ABN alone does not settle the question.

What this means in practice

Review the contract and what actually happens in the work arrangement. Employee status, super obligations, payroll tax and other issues can use different tests. Do not assume that a conclusion for one purpose automatically applies to every obligation. Obtain a review before deciding that no employment-related payments or reporting are needed.
